この文の「absent until now and with tragic consequences」が文法的におかしく感じてしまいます。つまり「Further consideration is being given to whether redefining Facebook and Twitter as publishing companies would force a duty of care towards their users」で文が完結しているように見えます。
普通はカンマのあとは前置詞が来て文が始まるか、ingやed系がきて分子構文になるかだと思うのですが、absentは動詞か形容詞しかないし原形だしで疑問です。
